Affiliate Policy

Introduction

The following Affiliate Partnership Terms & Conditions outline the rules, responsibilities, and benefits associated with participating in the FluentCart Affiliate Program. 

In exchange for providing genuine promotion of FluentCart, FluentCart Inc. will pay the Affiliate a percentage Commission of the price (excluding tax) of any valid sale to a third party who accesses “fluentcart.com” through a referral link on the Affiliate’s website or other channels.

These provisions govern how affiliates may promote FluentCart, how commissions are earned and paid, and the standards of conduct expected from all participants. 

By enrolling in the program, affiliates agree to abide by these terms in addition to FluentCart’s main Terms & Conditions and Privacy Policy.

1. Enrollment & Eligibility

1.1. To participate in the Affiliate Program, individuals or entities must complete the registration process by providing required details—including, 

  • Full name
  • Email address 
  • Username & Password
  • Promotion method
  • PayPal payment email, and 
  • Affirm agreement to the Affiliate Partnership Terms.

1.2. Enrollment is free and open to anyone, regardless of whether they’ve previously purchased FluentCart or not.

1.3. FluentCart reserves the right to reject or terminate applications at its discretion if promotional methods are deemed unsuitable.

1.4. Affiliates must comply with applicable laws, including advertising and privacy regulations (e.g., GDPR, CCPA, FTC disclosure rules).

1.5. Affiliates earn commissions only on first-time purchases of new FluentCart licenses (annual or lifetime).

2. Commissions

2.1. Affiliates earn a flat 20% commission on all first-time purchases made through their affiliate links, subject to the product’s license pricing tier.

2.2. Commissions do not apply to the following cases,

2.2.1. License renewals or subscription renewals.
2.2.2. License upgrades, downgrades, or plan switches.
2.2.3. Add-ons, upsells, or cross-sells, unless explicitly stated.

2.3. Each affiliate link uses cookie-based tracking for a duration of 60 days after a click. If a user clicks multiple affiliate links, the last affiliate link clicked before purchase will be credited with the commission.

2.4. FluentCart Inc. reserves the right to change Commission rates at any time they deem fit, with prior notice.

3. Commission Validation & Payouts

3.1. Commissions are placed in a pending state until after the refund period (currently 60 days) has passed.

3.2. Pending commissions exceeding $200 become eligible for payout after 60 days, subject to no chargebacks or refunds.

3.3. Payouts are made monthly via PayPal. Affiliates are responsible for ensuring accurate payout details.

3.4. FluentCart Inc. reserves the right to withhold or reject commissions in cases including, but not limited to:

3.4.1. Fraudulent, misleading, or manipulative referrals.
3.4.2. Self-referrals (purchasing through your own affiliate link).
3.4.3. Traffic generated through prohibited methods or policy violations.
3.4.4. Chargebacks, refunds, or cancellations related to referred sales.

4. Affiliate Links & Promotion Guidelines


4.1. Affiliates are provided unique referral links to track conversions.

4.2. As an Affiliate for FluentCart you agree to the following:

4.2.1. Use only the links, media resources, and banners provided by FluentCart.
4.2.2 Not alter or misrepresent links, tracking codes, media resources or customer journeys.
4.2.3 Not place affiliate links on:

4.2.3a. Coupon or discount aggregator websites.
4.2.3b. Demo sites, documentation pages, or knowledge base resources.
4.2.3c. Sites containing offensive, illegal, or misleading content.

5. Permissible Promotional Practices (Do’s)

5.1. Affiliates should comply with the following:

5.1.1. Provide quality, helpful content (e.g., blog articles, tutorials, case studies, videos, newsletters) related to/promoting FluentCart.
5.1.2. Educate audiences through thoughtful comparisons, solution-driven content, or product-focused messaging.

6. Affiliate Promotional Restrictions (Don’ts)

6.1. Affiliates are prohibited from:

6.1.1. Bidding on FluentCart trademarks, brand names, or variations in search ads (e.g., “Fluent Cart,” “FluentCart plugin”). Running ads/paid campaigns (search, meta, or other channels) against the brand name is prohibited, and will result in instant ban from the affiliate program without any prior notice
6.1.2. Using FluentCart’s domain name or URLs as ad display links.
6.1.3. Direct linking from paid search ads to “fluentcart.com” website or any other URLs on the domain.
6.1.4. Running misleading ads or misrepresenting FluentCart’s features or pricing.
6.1.5. Deploy non-productive or irrelevant links that do not serve business or user interests.
6.1.6. Use manipulative SEO tactics or unethical methods to inflate search metrics.
6.1.7. Create or promote content tied to controversial or sensitive issues.
6.1.8. Spamming (email, social, forum, or other forms).
6.1.9. Using adware, spyware, or cookie-stuffing techniques.
6.1.10. Misrepresenting FluentCart, its products, or its relationship with you.
6.1.11. Promoting on sites that host offensive, harmful, or illegal material.
6.1.12. Exploiting system loopholes, fraudulent activity, or self-referrals.

7. Affiliate Resources & Support

7.1. FluentCart provides affiliates with official marketing assets. This includes logos, banners (both generic and seasonal), infographics, and screenshots—to support quality promotions.

7.2. Affiliates have access to real-time tracking dashboards, performance monitoring tools, and dedicated affiliate support.

8. Affiliate Warranties

By participating, you represent and warrant the following

8.1. You have full legal authority to enter into this Agreement.

8.2. Your promotional methods comply with applicable laws and industry standards.

8.3. You will not engage in fraudulent, deceptive, or harmful marketing.

8.4. You will clearly disclose your affiliate relationship in accordance with FTC and other legal guidelines.

9. Intellectual Property & Content Use

9.1. FluentCart grants you a limited, revocable license to use approved logos, banners, and materials for promotional purposes.

9.2. You may not modify FluentCart’s branding or create misleading assets.

9.3. FluentCart reserves the right to require removal of any promotional content that misrepresents the brand or violates these terms.

10. Relationship of Parties

10.1. Participation in the Program does not create any partnership, joint venture, employment, or agency relationship between FluentCart Inc. and the Affiliate. Affiliates act solely as an independent party.

11. Term & Termination

11.1. Either party may terminate this Affiliate Agreement at any time, with or without cause, by written notice.

11.2. Upon termination, you must remove all affiliate links and stop using FluentCart’s promotional materials.

11.3. FluentCart reserves the right to withhold unpaid commissions in cases of fraud, abuse, or violation of these terms with or without explicitly revoking the Affiliate Agreement.

12. Indemnification

12.1. You agree to indemnify and hold FluentCart and FluentCart Inc. non-liable from any claims, damages, liabilities, or expenses arising out of your promotional activities, breach of these terms, or violation of laws.

13. Limitation of Liability

13.1. FluentCart is not liable for indirect, incidental, or consequential damages, including lost profits, arising from participation in the Program. 

13.2. Maximum liability shall not exceed the total commissions paid to you in the 6 months preceding the claim.

14. Severability

14.1. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

15. Amendments

15.1. FluentCart may update these terms at any time without prior notice. 

15.2. Continued participation in the Program after changes constitutes acceptance of the revised terms. 

15.3. Affiliates will be notified of material updates in reasonable time at the discretion of FluentCart Inc.

16. Governing Law

16.1. This Agreement is governed by the laws of the United States (US), where FluentCart is an incorporated entity. All disputes arising or pertaining to these terms will be mitigated based on US legislation.
